Human Rights Law Out of Touch?

European judges have ruled that whole-life jail terms, without the possibility of review, amount to a breach of human rights.

http://uk.news.yahoo.com/ruling-due-...5.html#TLQCtd5

Is this going too far if the evidence against the criminal is overwhelming and the criminal is deemed as incorrectable?

Should the whole Human Rights Act be rewritten? What parts would you like to see changed, removed or added?

Most of the human rights laws are perfectly fine as written trouble comes when it is interpreted wrongly IMO, But whole life tariffs are IMO necessary so should be left alone.

It doesn't matter what the EU judges say really, some prisoners may get their review but they will never be released.
Under current UK law, whole-life tariff prisoners will almost certainly never be released from prison as their offences are deemed to be so serious.
They can be freed only by the Justice Secretary, who can give discretion on compassionate grounds when the prisoner is terminally ill or seriously incapacitated.

Re: Human Rights Law Out of Touch?

Since 'whole life tariffs' are now deemed illegal by the ECHR, judges can still circumvent this ruling by giving an actual time-limited sentence - like 99 years (as they do in America).

Because Annie darlin' we are now a civilised societuy that abolished capital punishment some 50 odd years ago, as our (imperfect) legal system could not undo wrongs against people wrongly convicted of a capital crime.

No Arthur matey - that requires the signature of three doctors independently to corfirm a diagnosis of mental insanity.

Then set a release date, say after they reach somewhere between 75 - 90 depending on what age they are when the murder was committed.
