It arose out of the European Convention on Human Rights following the end of WW2. It was substantially written by British lawyers. It is not part of the European Union. Prior to the incorporation of the convention into uk domestic legislation (Human Rights Act 1999) unresolved cases that had exhausted all domestic legislation (Supreme Court - formerly the House of Lords judicial Court) had an expensive and time consuming wait in a queue of cases awaiting judicial decision. Following the incorporation of the convention into domestic legislation it is no longer necessary to invoke 'Human Rights' matters in the European Court of Human Rights, but can be directly pleaded before all domestic courts.
