How it works is this.
We have a completely bizarre interpretation of Human Rights Legislation, in particular the right to family life, Article 8.
You are an illegal, you come to the UK, you father a child, bingo.
It is the same with foreign criminals and terrorists.
It is so common there is a name for it, baby fathers.
It has naff all to do with the EU either, an extract from an article on the subject.
The real problem, however, is the way in which Article 8 of the Human Rights Act, the right to family life, is interpreted. It is quite wrong to think that the deportation of a criminal, particularly one convicted of a serious, violent crime such as rape or murder, must be a “disproportionate deprivation of family life”. It is not. And there is nothing in the European Convention on Human Rights that requires the right to family life be interpreted in so broad and, frankly, so ludicrous a way. The Government must ensure that British judges interpret this much abused right in the way that the framers of the convention intended.
The above Article was written in 2011, plenty of time to have resolved the issue.
