Thoughts wanted please...

I'm at the very early stages of buying a house.

When I went to view the house the vendor implied the TV attached to the units was staying. (TBH I didn't see it there, it blends in ). She turned it on to show me and that it moved from side to side in the same position (gawd knows why). She said if it was taken away there would be a hole in the unit, which would either need filling or install a new frontage.

It's a kitchen diner and it's attached to the frontage of the unit, (in other words you'd see the residual hole/s in full view). See piccie.

When I went the 2nd time I asked where the aerial was for it and she said it ran from outside and then inside the units, as was the electric sockets. On neither occasions did she mention payment for it.

QUESTION:

I got the Fixtures and Form today. It says the TV is 'excluded' , that it's a smart TV that cost £400 in 2015. (no other comments made, ie if it was up for negotiation).

It wasn't mentioned on the Estate Agents details as part of the salel. ( BTW the E.A. had included the sofa in the sale, which was later taken off as that was incorrect).

If she is removing it, I want the unit frontage to be completely renewed matching the current black gloss units, I don't want to looking at a filled in bit ruining the look of the units (or maybe I offer her £100 or something for it? )

(I don't particularly want it, but I wouldn't say no if it was free. I certainly don't want to fork out for a new frontage and pay for labour charges)

I think if it was me, I would insist that the tv is included in the sale. I doubt if they would want to mess up the sale of their house for the sake of £400, in fact the tv is probably worth next to nothing now anyway. Explain that you were told it was included initially.

I would talk to your solicitor about it and ask them to get it in writing.

Yes, I only got the form today about 3ish from the solicitor (late mail here) , and the solicitor was busy when I called him. He'll be phoning tomorrow. I just really wanted to get others' views to see if they were anything else than mine before I spoke to him.

She 'implied' it was staying rather than saying it was. And, like you I thought it would be pretty valueless now anyway.
I feel cross with her. I hate liars. If she's going to be an arse about anyting, if I'm not careful I'll way. But that would upset my buyer who's been waiting since October last year

Surely it's a fixture and fitting ?? That is the unit was designed for the tv, that if it hadn't been the unit would just be a flat panel

No Missy, the TV is proud of the unit not integrated. Think the shadow makes it look like it could be integrated.

So you think I insist she leave it doc - even tho' she only 'implied'?

It's such a grey area.

Ahhhh, I see now

I would just say to the vendor, excuse me but you told me the TVs was being left, but now you have filled in the forms saying its excluded, can you confirm it is staying

She will be so flummoxed she will agree that it was all a mistake and yes it's included Hopefully

If she is insisting on payment, it's a 4 year old tv, I wouldn't even go as far as £100 UNLESS it was a top brand. A replacement yourself would only be £150 - new

She's one of those pleasant types, but under the surface you feel she could rip your throat out if you said something she didn't like

The TV's from 2015, so it's only just 3 yrs, if that. I did think of £50

As I say, I'm not bothered if I have it not, but I wouldn't say no if it was free.
It's the unit that concerns me more in that she might just fill the hole and so end up ruining the 'look'.
I don't want to be landed with paying for a new panel and installation after she just filled the hole/s.

Tell them you want a further reductin to remove units and make good decor behind them....or leave the TV.
