Judge rules against care plan for man who hasn't the mental capacity to understand

A female judge has ruled that a 36 year old man who hasn't the mental capacity to understand consent in his search for sexual encounters has the right to pursue sex as a basic human need .
Ought this to have overruled the care plan the authorities wanted ?

Sex isn't a right it's a privilege if you meet someone who finds you attractive too. With her views I guess she doesn't believe rape within marriage is wrong either.

Would he though, because of mental impairment his responsibility could be deemed as significantly diminished.

No, it should not! because if he were free to do this it is probable
that he will infringe on another persons right to refuse?
Seems straightforward to me!

Perhaps they should castrate him chemically, then he has no

Valid point, protecting both him and any partner until a relationship has developed. Casual sex with prostitute may not be what this man wants, but would hopefully prevent him from breaking the law.

Exactly how I feel too, donkeyman. although the chemical way isn't permanent as I understand.
