Justice.

There is a case in today's paper of a 19 month old boy who the police know for sure was killed either by it's mother or her boyfriend. Both blame each other for the murder so the police cannot prosecute as they do not know which one did it. IMO both should be locked up as one is guilty and the other is lying and they know which is which so they are as guilty as each other.

Surely 'Conspiracy to murder' is still a statutory offence in England, Wales, Northern Ireland and the Republic of Ireland ? Could they prosecute both of them for that?

I dont agree they should both be charged, that is wrong if one is not guilty. A person is innocent till proven guilty in this country and that should go for any murder.
It is up to the police to produce the evidence, it may take months to break the murderer down, but they have to.
The forensics might be wrong anything can be a problem, they may have alibis that the police can't refute, maybe witnesses are mistaken about time etc.

I ain't got a clue in this particular case, but what is for sure is, for the law to work for the majority, in most cases, it has to be an ass in some circumstances, it would be good if everything was Black and white.

According to the newspaper report the police know for certain that one of them is guilty and so do they as they are accusing each other. But, apparently, only one of them can be charged and, until they have evidence to say which one is guilty, neither of them can be charged. I assume the police know what they are doing.

Seems all wrong don't it. Somebody has obviously done it, and the police have got to work harder to get the evidence then. They both must know a lot more than they are saying, so its up to the police to complete the jig-saw.

Yes...and ultimately both will also be charged with perverting the course of justice.
