Re: You c an't win

We put in for permission to have them topped to reduce the height. The person from the council came around and said all we were allowed to do was trim the trunk and remove any dead/dangerous wood. they did also allow a few foot off overhanging branches

this is from our council

That post code is not ours bt the councils

So we can't touch the trees, Fines are really heafty if we did like imprisonment and/ or thousands of pounds in fines
The application was submitted for us by a professional company who do tree work

Yeah, Realspeed, all Councils' arboriculturists have you over a proverbial barrel when it comes to working on trees covered by TPOs as we found out at our last digs near London. Our apartments' management company wanted to top some sycamores along the river bank that bordered our development (they were destroying the bank and brick-built Victorian wharfage). Along comes the tree fella and looks at the trees along the bank and says, "No. Absolutely not. Even though they have disease ridden branches, they're not bad enough to fell yet. Oh, that one's rotten through. OK, that one can come down."

When he'd gone, the tree surgeon got his kit out and all of them were topped by 2m. The rotten one felled. The moral - don't let the barstewards see you do the job!

Why do you say - "You can't touch the trees"?

It clearly says in that letter that you CAN trim them, but you can't lower the height by the 15ft applied for - not for the reasons you gave them anyway.

They have however, granted permission for you to trim the lateral branches by up to 10ft.

It also notifies you that any dead or dangerous branches can be removed without formal permission.
