He won't be busy for some time. First you have to ratfy the withdrawal agreement. Then, and only then, negotiations about a trade deal can commence with phil and sabine.

That, coupled with the PM’s refusal to extend, means the EU Commission will not be legally constituted on November 1 because of Article 17 of the Treaty of the European Union. If the EU member states try to change the rules, Mr Johnson can use the British veto to prevent it.”

If this were true, than there is a problem already. Estonia's Commission seat is vacant, following the resignation of*Andrus Ansip*as Vice-President for the Digital Single Market on 1 July 2019. Estonia has nominated*Kadri Simson*to serve for the remainder of the Commission's term, but he has not been confirmed by the European Parliament. Responsibility for the Digital Single Market portfolio has been transferred to the Vice-President for the Energy Union.^*Romania's Commission seat is vacant, following the resignation of*Corina Crețu*as Commissioner for Regional Policy on 1 July 2019. Romania has nominated*Ioan Mircea Paşcu*to serve for the remainder of the Commission's term, but he has not been confirmed by the European Parliament. Responsibility for the Regional Policy portfolio has been transferred to the Commissioner for European Neighbourhood Policy & Enlargement Negotiations.

So now three seats will be vacant, until suitable candidates are put forward.

Have any of them been confirmed yet ? I thought as today they were announced they are all nominations for the positions . The Irish one is.

Each Commissioner is first nominated by their member state in consultation with the Commission President. The President's team is then subject to hearings at the european parliament, which questions them and then votes on their suitability as a whole. If members of the team are found to be inappropriate, the President must then reshuffle the team or request a new candidate from the member state or risk the whole Commission being voted down.
Although members of the Commission are allocated between member states, they do not represent their states; instead they are supposed to act in European interests. So, in principle, these interests can be represented by 27 persons, or even less. The UK not (yet) sending a representative is no obstacle for functioning of the commission.
