As a former restaurant owner I can tell you that it is more complicated than it sounds. While I'm sure that you would not abuse the privilege, many people do.Bums off the street know where they can find a toilet and they bathe in there, steal all of the toilet paper and generally make a mess.
Once upon a time, restaurant toilets were open to all, but since the privilege was abused, restaurants have begun to crack down.
I have bowel trouble and I have discovered that if you just walk in, and use the facilities, few owners will object. Especially if you look clean and neat.

In parts of America They do, if its the very dry zone.
They are no washing facilities available there is no drinking water available they are not allowed in places ware they can have access to theses
San Francisco spends Millions cleaning up the Drug needles and the shit from the streets from druggies who have no access to business toilets.

A fact.In Nevada and Arizona in the summer months if the temp is to hit over 105f the charities mobilize to get water to the homeless they open centers to hand out the water and is stated on the local TV station
Certain business will give free bottles of water to the homeless.
The homeless in Vegas can sneak into a Casino and as I have witness strip down and wash in the toilet and fill up bottles of water from the basin taps, that's if they are not spotted before by security and not allowed in.
