That applies only in those cases where a migrant seeks refuge in an EU member state. Based on the 1951 geneva convention they can, but need not do that. They can travel on to the good old britain and apply there.
During the transition period the UK is treated as a member, which entitles them to send back refugee seekers to the country of entry. After 31 december 2020 that ends. So if a refugee enters greece, spain, italy etc and expresses the wish to travel to britain, we put them on a plane to heathrow and wish them luck.
Thanks for your explanation. Could you please also tell me, if you happen to know, what is the procedure when the police of any EU state, stop illegal immigrants hellbent on reaching the country of their choice (for whatever their reason) and the police find that they chose not to register as they were meant to at the first safe EU state they arrived in? Are they arrested? are checks made to ensure they are who they say they are? Are the many who have deliberately tossed away their passports - especially thoroughly checked out to see if they are telling the truth as to who they are and where they are saying they have come from? or is it, as one hears, they are simply let out to continue onto the next member state and their eventual destination in the hope they can avoid capture again, for whatever reason.
One would imagine if their chosen destination is the UK, not many checks would be bothered with?
If so, that is a very disturbing thought, but I genuinely wish to know the answer to the above (without point scoring).
One last question, if the EU authorities are doing their job correctly when these illegals are caught, should they then ever be in a position where they have reached the sandy shores of Calais considering free movement is for EU member state citizens only.?
