Making a new will

A friend was telling me last evening that she and her husband went to a solicitor to draw up a new will and were told they HAD to have a Power of Attorney to accompany the will - something to do with identity theft, data privacy etc etc.

Can anyone confirm or not?

Never heard that one before .
However it would be quite useful if one or the other got something like dementia and was unable to manage their own affairs.
Without a POA this would be very difficult .
It is however not AFAIK a requirement in making a will .

Hi

Absolute Rubbish.

My will is very simple.

Everything to Guy.

Signed delivered and registered.

He is sole Executor and has my passwords.

In the event that he dies before me, everything to my daughter.

There is no Power of Attorney

It is set in stone.

It’s while you are alive Swims that a POA might be needed .
When you die the POA ceases to be .

I also thought it was a money-grabbing exercise by the solicitor but thought I'd ask on here in case I'd missed some new legal requirement - so if anyone has recently seen a solicitor about a will, can you please confirm?

Absolutely no Power of Attorney.

There is no way I will be in a nursing home or having Dementia.

I just had a quick Google and can't see anything about HAVING to have a POA although it is advised, especially for older people.

Try this site, it's Age UK, there's a Freephone number you can ring and ask for advice.

We had our will drawn up about 15 years ago, it stipulates both out son and daughter will have joint POA if needed in future years.

Thanks Nicol - It looks as though it's advised but not statutory. I'll take a look at the advice and decide for myself.

I had this discussion last time I was in Hospital.

My response was very simple.

You know the Phrase A Drowning man will clutch at straws.

That is not me, so sod off and worry.

Do not resuscitate and I will survive and become your worst nightmare.
