I have always argued this because it effectively denies anyone who has been summarily dismissed access to justice. If you have just been sacked you are unlikely to have approx £1200 in spare cash.
Gosh that's a lot! Does it get paid for if you win?
I took one of my employers to a tribunal back in the early 90's, they had to pay expenses as I won my case, representing myself but I don't know if I would have had to pay if I had lost.
This was sneaked in by the Coalition in 2013 by that Grayling person and I don't think you do get your money back if you win the case.
Our Union undertook to lend claimants the money, providing they were happy there was a case to be answered, and would then forget to ask for the loan to be repaid.

This is good news so many have been denied access to tribunals it's criminal. I absolutely agree the frivolous cases had to be stopped but this was sledge hammer to crack a nut.

That was the point of a 'preliminary hearing' to discover whether there was any merit in the case.
