I hate this Americanism of suing for everything and anything, and trying to make money when it's your own fault entirely.
It doesn't matter if the mat was old or not. Mats for use on shop floors, especially vinyl floors must be slip and trip proof. If not then they must not be used.

IF THERE WAS A MAT INVOLVED IT WAS NOT HER FAULT.

100% agree. There are mats on the market that are guaranteed 100% slip and trip proof. I can even direct you to a couple of Malaysian manufacturers if you are interested.

Truth you have to be so careful these days when suing for damages against stores.
I saw in the news a while back how a couple of Asian women tried it on with one of the major supermarkets.
One shouted for help whilst the other was crying that she had hurt her leg or foot when a pack of cans had fallen onto her from a pallet at the doorway whilst they were shopping.

Silly buggers got caught out when the security re run the entrance camera to that time and saw the women place the tray of whatever it was onto the floor and then called for help.

Needless to say they got away with a warning because it would have been racist to fine them for wasting time and trying to get money out of the store fraudulently.

It should have been impossible for her to trip on any mat no matter what she was doing.

Human nature is to initially think "Oh! What have I done?" with the emphasis on the " I". ie to blame one's self.

Especially amongst older people because they don't grasp that today the onus is on providers of public spaces,shops, etc. to de-risk EVERYTHING using state of the art ways and means.

Another case of how important it is to live in today's world.

You can't blame others for your own carelessness.

It's like people who are on their mobile phones, and walk into a lampost. Should the lampost not have been their either?

I don't like people who try it on to make money out of others.

You guys just don't get it.

It is the legal responsibility of (in this case) the kiosk operator to ensure that it should not be possible to trip over a mat under any circumstances and short of bending down and twisting it yourself to create a hazard no matter how attentive or not you might be you should not be tripped up.

There are a number of mat designs for use in public areas. Those most widely used have a thin rubber strip around the mat to minimise the trip hazard. Others do not and should never be used in public areas.

If she fell over the mat unless she was drunk or high on weed or crack then she really does have a legitimate claim because IT WAS NOT HER FAULT.
