Re: Cyclist and the yoga teacher

Whether we walk, drive or cycle, we all have a responsibility to watch out for each other.

Worth reading the comments in this article .

I too am puzzled as to how the judge judged them equally at fault bit he has to pay her costs ?

This is a travesty of justice .

But a win win situation for the lawyers.

“This was not because I was not injured, but because I do not advocate the claim culture."
A decent guy, unlike the greedy lawyers.

Once the cyclist was aware of what was happening to him legally, I think he needed to hire his own lawyer.

Yes, but also to watch out for people who might not be watching out.

Re: Cyclist and the yoga teacher

A cautionary tale for commuter, or even casual, cyclists. Get some insurance. Insurance cover for third party claims isn't very expensive. Nice to know that I'd have legal representation against a careless pedestrian like the one in question here.

Re: Cyclist and the yoga teacher

Having read all the posts on this thread so far, l have come
to the conclusion that the the judgement was incorrect?
Imo the blame was NOT equal, the pedestrian was more to
blame than the cyclist! I would say by a factor of 75% - 25%
The pedestrian in this case was totally unaware of her
surroundings and was therefore gulity of gross negligence
which led to the accident taking place?
The cyclist was only guilty of making a small error of
judgement, he was obviously paying attention to what he was
doing as he sounded a warning to the woman, who, however
either did' not hear it or chose to ignore it?
Before crossing a road a pedestrian used to be taught to
look both ways, LOOK RIGHT, LOOK LEFT, LOOK RIGHT again!
BEFORE croossing?
This seems to have been dropped since the advent of smart
phones and streamed music?

Re: Cyclist and the yoga teacher

Thinking further on the implications of the Court awarding compensation to the pedestrian, I wonder if I should get a body or helmet cam?

A pedestrian on the make could 'accidentally' walk out in front of a cyclist, take their chances on injuries (or fake injuries) and make a claim. They'll know there has been a precedent for receiving compensation now.

There's probably only a small chance of that happening around here and I have got third-party cover. However, I still wouldn't want the hassle of a Court case if it did happen. A recording might avert that.
